Terms of Service

1. Acceptance of Terms

By accessing, registering, or using the Trainer24 application ("Application") and related services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to any terms, please stop using the Application immediately. These Terms constitute a legally binding agreement between you and Trainer24 ("we", "us").

2. Definitions

• •"User": means any individual who registers and uses the Services, including "Trainers" and "Trainees".
• •"Trainer": means a service provider who registers as a trainer on the platform.
• •"Trainee": means a service recipient who registers as a trainee on the platform.
• •"User Content": means all data, images, text, and content that users upload or create in the Services.

3. Description of Service

Trainer24 is a management platform for personal trainers and trainees that provides:

• •Schedule and training management system
• •Package and session management system
• •Income recording and analysis system (for trainers)
• •Public profile creation system
• •Workout logging system
• •Notification and communication system between trainers and trainees

4. User Accounts and Registration

• •Eligibility: You must be at least 18 years old to register for the Services.
• •Accuracy of Information: You agree to provide accurate, complete, and current information and to keep such information up to date.
• •Account Security: You are responsible for maintaining the confidentiality of your password and account information, and for all activities that occur under your account.
• •Incident Reporting: You must notify us immediately of any unauthorized use of your account.

5. Subscriptions and Payments

• •Service Plans: Services are available in both free and subscription tiers as specified in the Application.
• •Payments: Payments are processed through Apple App Store or Google Play Store payment systems according to their respective terms.
• •Auto-Renewal: Subscriptions automatically renew unless you cancel before the end of the billing cycle.
• •Refunds: Refund policies are subject to the terms of Apple App Store or Google Play Store.

6. User Conduct

You agree not to:

• •Use the Services for illegal purposes or in violation of these Terms
• •Upload defamatory, obscene, or rights-infringing content
• •Impersonate others or provide false information
• •Attempt unauthorized access to systems or data
• •Disrupt, damage, or place unreasonable burden on servers or networks
• •Use automated programs (bots, scrapers) to access the Services
• •Resell or sublicense without written authorization

7. User Content

• •Ownership: You retain ownership of content you create or upload, but you grant us the right to use, store, and display such content as necessary to provide the Services.
• •Responsibility: You are responsible for all content you upload and warrant that it does not violate any laws or third-party rights.
• •Content Removal: We reserve the right to remove content that violates these Terms or applicable laws without prior notice.

8. Intellectual Property

All content in the Application, including but not limited to software, text, graphics, logos, icons, images, and data compilations ("Company Content"), is the property of the Company or its licensors and is protected by copyright and intellectual property laws of Thailand and international laws.

9. Disclaimer of Warranties

The Services are provided "as is" and "as available" without any warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or freedom from defects. We do not warrant that the Services will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the fullest extent permitted by law, the Company, its directors, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use or inability to use the Services, including loss of data, profits, or business reputation, even if advised of the possibility of such damages.

11. Indemnification

You agree to defend, indemnify, and hold harmless the Company, its directors, employees, and agents from any claims, damages, liabilities, and expenses (including attorney fees) arising from your use of the Services, violation of these Terms, or infringement of third-party rights.

12. Account Suspension and Termination

• •User Termination: You may terminate your account at any time through the settings in the Application.
• •Company Suspension: We reserve the right to suspend or terminate your account for violation of these Terms without prior notice.
• •Effect of Termination: Upon termination, your right to use the Services ends immediately. Data will be handled according to our Privacy Policy.

13. Dispute Resolution and Governing Law

• •Governing Law: These Terms are governed by and construed in accordance with the laws of the Kingdom of Thailand.
• •Jurisdiction: Any disputes arising from or related to these Terms shall be subject to the jurisdiction of Thai courts.
• •Mediation: Before initiating legal proceedings, the parties agree to attempt to resolve disputes through good faith negotiation or mediation.

14. Changes to Terms

We may modify these Terms at any time. When significant changes are made, we will notify you through in-app notifications or email. Continued use of the Services after changes constitutes acceptance of the new Terms. If you do not agree, you may terminate your account.
